SEC Releases Investor Alert, Urges Caution on Crypto Investing

On Thursday, the US Securities and Exchange Commission (SEC) released an investor alert advising caution when dealing with crypto asset securities. The SEC cautioned that companies offering crypto investments may not be adhering to US laws. Additionally, unregistered offerings in crypto asset securities may not provide investors with vital information for making informed decisions, such as audited financial statements.
The SEC also emphasized that investing in crypto asset securities can be highly risky and prone to volatility. They pointed out that a number of significant platforms and crypto assets have become insolvent or lost value in the past year. Furthermore, it warned that fraudsters are taking advantage of the increasing popularity of crypto assets to deceive retail investors into scams, resulting in significant losses. The agency emphasized that relying on celebrity endorsements is not a sound investment strategy and does not guarantee the legitimacy or suitability of an investment.
To protect themselves, the SEC encouraged crypto investors to have a well-defined investment plan, as well as to assess their risk tolerance and investment horizon.

The SEC warned that proof of reserves may not be a reliable indicator of whether crypto asset entities hold enough assets to back their customers' balances. Instead, investors should rely on audited financial statements rather than these services, which could be used to confuse customers about the safety of their assets.

In the past, the SEC has tried to show that numerous crypto exchanges are running as unregistered securities exchanges in the United States. This point of view has been frequently expressed by SEC Chair Gary Gensler. The warning from the regulator was issued the day after Coinbase (COIN) revealed that it had received a Wells Notice from the SEC, suggesting that there could be an impending enforcement action associated with the exchange's listing of potentially unregistered securities.
