In the event that the United States Securities and Exchange Commission denies approval for spot Bitcoin ETF applications, JPMorgan suggests that legal action may be pursued by the applicants, as per a recent The Block report. In a recent report, JPMorgan's analysts, led by Nikolaos Panigirtzoglou, emphasized the potential for lawsuits against the SEC, though they acknowledged that such a rejection is unlikely but not impossible. Panigirtzoglou stated, "We believe that the SEC would prefer to avoid a new legal battle over the approval of a spot bitcoin ETF."
Notably, the SEC recently lost a case brought against it by Grayscale Investments, resulting in a court ruling in favor of the crypto asset manager. This ruling mandated the SEC to reconsider Grayscale's application to convert its bitcoin trust into a spot bitcoin ETF.
JPMorgan anticipates that multiple spot bitcoin ETF approvals could come within months. The bank also notes that asset managers are making progress with the SEC, addressing technical issues and amending filings to address concerns related to market manipulation and customer fund commingling.
The recent surge in the price of Bitcoin, up nearly 20% in the last week, is attributed to growing optimism about the approval of a spot bitcoin ETF and other factors. JPMorgan analysts highlight that this Bitcoin rally is primarily driven by institutional demand, marking a shift from previous quarters that were more retail-driven.
They point to indicators like the increase in futures positions, particularly in CME Bitcoin futures, which are predominantly used by institutional investors. Additionally, a substantial inflow of Bitcoin into larger wallets underscores the heightened institutional interest in the cryptocurrency.
