Gary Gensler, Chair of the Securities and Exchange Commission, has raised concerns about the involvement of multiple malicious actors in the cryptocurrency space and emphasized the prevalence of fraud within the sector. A recent The Block report states that during DC Fintech Week, he stated, "It's not just about one isolated incident and one infamous fraudster; there are several notorious fraudsters."
Gensler's comments follow the recent conclusion of former FTX CEO Sam Bankman-Fried's criminal trial, where he was found guilty on all counts for defrauding investors. The SEC had filed a lawsuit against Bankman-Fried late last year and has since brought additional charges against various cryptocurrency companies and individuals.
When asked about the SEC's decision-making process regarding enforcement actions, Gensler explained, "We need to carefully consider our resources because, unfortunately, there is a multitude of complaints, and not all of them are the same. There are many unscrupulous actors in the space. We focus on accountability and holding individuals responsible, prioritizing high-impact cases and examining the roles of gatekeepers in our enforcement efforts."
In fiscal year 2022, the SEC initiated 760 enforcement actions and doubled the capacity of its Crypto Assets and Cyber Unit. A report on fiscal year 2023 statistics may be released as early as this month.
Gensler also addressed the use case of cryptocurrency and investor protection. He emphasized the need for investors to understand the practical applications of the thousands of individual tokens in the market, saying, "What is the practical purpose of these 15 to 20,000 tokens? We are neutral on merit, but investors need to comprehend their use cases."
