Reuters reported that Sam Bankman-Fried, the founder of FTX cryptocurrency exchange who is facing charges, is making efforts to evade imprisonment over concerns of excessive disclosure to the media. He has enlisted the expertise of a renowned American constitutional law authority to assist in his defense.
Laurence Tribe, a respected professor at Harvard Law School, submitted a court filing on Tuesday night asserting that Bankman-Fried's disclosures to the New York Times regarding a former colleague did not appear to meet the criteria of "clear and convincing evidence" required to establish witness tampering, a condition necessary to warrant the potential incarceration of the 31-year-old.
U.S. District Judge Lewis Kaplan in Manhattan is currently deliberating on whether Bankman-Fried's bail should be revoked due to his provision of personal writings of Caroline Ellison, the former CEO of FTX-affiliated hedge fund Alameda Research, to the Times.
Bankman-Fried has entered a plea of not guilty to allegations of embezzling billions of dollars from FTX customers to cover losses at Alameda. Ellison is anticipated to testify against the former billionaire during the scheduled trial on October 2.
According to Tribe, Bankman-Fried possesses the right to shape his public image through media under the First Amendment, as long as such actions do not obstruct justice. Tribe contends that Bankman-Fried's involvement in the Times article about Ellison seems to have served as a supplementary source and does not clearly constitute witness tampering. Tribe's filing suggests that the government might be urging the court to presume malicious intent based on an otherwise lawful exercise of Bankman-Fried's constitutional rights to communicate with the media.
