Former FTX Auditor Faces SEC Charges for Independence Violations

Reuters reported that the U.S. SEC announced on Friday that it has filed charges against the accounting firm Prager Metis, which previously conducted audits for the FTX Group, for numerous violations of auditor independence regulations.

The SEC revealed that between December 2017 and October 2020, Prager Metis inappropriately added indemnification clauses to engagement letters for over 200 audits and related services, thereby violating legal requirements for auditor independence. Despite being alerted to this issue by senior partners within the firm, Prager Metis continued to include these provisions in their engagement letters.

It's worth noting that Prager Metis was one of the auditors for the FTX Group, a cryptocurrency exchange that filed for bankruptcy in late 2022. Subsequently, the U.S. government accused FTX, its founder, and key executives of involvement in a large-scale fraudulent scheme. The trial for FTX's founder, Sam Bankman-Fried, is set to commence next week.

The SEC has initiated a lawsuit against Prager Metis CPAs and its professional services firm, which was filed in the U.S. District Court for the Southern District of Florida. The SEC is seeking various remedies, including injunctions and penalties, and its investigation into Prager Metis remains ongoing.
