Digital Currency Group Seeks Dismissal of Gemini Lawsuit Alleging Fraudulent Activity

CoinDesk reported that Digital Currency Group has submitted a motion requesting the dismissal of a lawsuit that was filed by the cryptocurrency exchange Gemini last month. The lawsuit accused DCG and its founder, Barry Silbert, of engaging in fraudulent activities through DCG's subsidiary, Genesis, which held funds for Gemini's Earn program.
Gemini's lawsuit, filed on July 7, alleged that DCG and Silbert misrepresented the financial state of Genesis, thereby encouraging customers of Gemini Earn to continue participating in the lending program. This was despite DCG and Silbert's awareness of a significant financial shortfall in Genesis' balance sheet, stemming from the collapse of Three Arrows Capital (also known as 3AC), a crypto hedge fund, the previous year.
DCG's response, provided on Thursday, contended that Gemini had not presented sufficient evidence to support its claims of fraud in the lawsuit. DCG, which owns CoinDesk, stated that Gemini's complaint seemed to be part of a larger strategy by the Winklevoss twins, the owners of Gemini, involving a public relations campaign that aimed to shift blame away from themselves. DCG emphasized that neither it nor Silbert had direct involvement in the Gemini Earn program's operations.

Furthermore, DCG argued that Genesis was not a defendant in this case and that Gemini had actively encouraged its customers to lend their digital assets to Genesis, implying that Gemini had endorsed the subsidiary as a reputable and vetted market participant.
